Employment Agency Statement

1. Identity and Legal Basis of the Employment Agency

Bao Ao Employment Agency (the "Agency") (Macao Employment Agency Licence No.: 202308) is an institution duly established in the Macao Special Administrative Region holding a valid employment agency licence. All of its employment-agency activities are conducted in accordance with the prevailing laws and regulations of Macao.

The Agency provides employment-agency services in accordance with the law, including but not limited to recruitment matching, CV processing and recruitment referrals.

 

2. Division of Roles with the GoGoJobs Platform

The Agency hereby declares and clarifies:

GoGoJobs is the operator of a recruitment-information and technology platform that merely provides systems, technical interfaces, information display and data-transmission support;

GoGoJobs is not an employment agency, and does not engage in any business that is, by law, within the scope of an employment agency;

All conduct that, by law, falls within the business scope of an employment agency — including CV collection, evaluation, recruitment matching, and the active or passive recommendation or referral of jobseekers' CVs to employers — is independently handled by the Agency under its own legal responsibility.

 

3. Statement on CV Processing and Active Recommendation

Once a jobseeker submits a CV or related information through the GoGoJobs platform, the Agency will, in its capacity as the employment agency and the relevant personal-data controller:

Conduct a professional evaluation of the CV based on its content, the jobseeker's career intentions and prevailing market demand;

Where lawful and reasonable, proactively recommend or push the relevant jobseeker's CV to employers it considers suitable;

Such recommendation or push activity is limited to recruitment and employment-agency purposes and complies with applicable laws and data-protection requirements.

3.1 Background Checks and Handling of Check Results

To enhance the quality of recruitment matching and to assist employers in making more informed hiring decisions, the Agency may, with the express consent of the jobseeker, conduct background checks ("Background Checks") on the jobseeker, including:

Verification of educational and professional qualifications;

Verification of work experience and employment records;

Verification of publicly available professional information.

The Agency may, subject to the jobseeker's separate express consent, share an objective summary of the background-check results (excluding subjective evaluation) with prospective employers that have expressed hiring interest in the jobseeker, solely for the purpose of recruitment assessment.

The jobseeker may withdraw such consent at any time through the platform or by contacting the Agency; such withdrawal may affect the progress of related job applications.

 

4. Statement on the Limits of Responsibility after CV Referral

The Agency expressly clarifies:

Once a CV has been lawfully recommended, referred or pushed to an employer, whether to contact the jobseeker, arrange interviews, hire the jobseeker and the actual terms of employment shall be at the employer's sole discretion;

Any disputes, risks or consequences arising from the employer's subsequent recruitment conduct or final hiring decision shall be borne by the employer and the jobseeker in accordance with the law;

The Agency shall not be responsible for any final hiring decision of the employer or for the formation of any employment relationship.

 

5. Statement on Employer Misuse of CVs and Limitation of Liability

The Agency solemnly declares:

Employers may use jobseekers' CVs and related information only for recruitment and selection purposes;

If an employer breaches the law or applicable terms and uses a CV or personal data for purposes outside recruitment, all resulting legal liabilities and losses shall be borne solely by that employer;

In such circumstances, the Agency shall not bear any joint, substitute or supplementary liability, and reserves the right to immediately terminate the provision of employment-agency services to that employer.

 

6. Right to Compliant Management of CVs and Data

To comply with legal, regulatory and compliance requirements, the Agency hereby declares:

In the following reasonable and necessary circumstances, the Agency is entitled to take compliant action with respect to CVs or related data, including but not limited to restricting use, ceasing referrals or deletion:

Where the data is clearly inaccurate, misleading or potentially unlawful;

Where the processing or use of the data is in violation of applicable laws or terms;

Where required by government regulation, legal obligation or risk-management considerations.

Such action is limited to lawful, compliance and risk-control purposes.

 

7. Data Protection and Legal Compliance

The Agency undertakes to adopt reasonable technical and organisational measures, in accordance with the Macao Personal Data Protection Act and related laws, to protect the security and lawful use of the personal data of jobseekers and employers.

 

8. Final Statement

This Statement is intended to clearly define the Agency's roles, responsibilities and authority in employment-agency activities, and forms a complete compliance framework together with the related platform terms, terms of use and privacy policy.

 

9. Governing Law and Jurisdiction

The interpretation, validity and enforcement of this Statement shall be governed by the laws of the Macao Special Administrative Region, with the Macao courts as the courts of first instance.
